Rialto Auto Accident Lawyers Top Ten Worst Excuses for a Car Accident

1. I was eating. It was hard to watch the road and eat at the same time.

2. I spilled my coffee.

3. He came out of nowhere.

4. He must have been going really fast because I never saw him.

5. He stopped right in front of me.

6. I’m sure the light was green.

7. It was raining.

8. My brakes must have failed.

9. He should have seen that I was making a u-turn.

10. The other cars waived me to go ahead.

Here are ten useful tips of advice from an auto accident lawyer to follow if you have been in an accident. You can also learn more about how to handle an auto accident in Rialto, or any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com  and learning how we can assist you.

Obviously, if you have had an accident, and you are reading all of this advice, it’s probably been at least a few days since the accident. However, if it’s only been a few hours or if you ever have another accident, here’s what you should do the next time from the start.

First, take a look around and determine if you or anyone, are hurt. If so, taking steps like trying to prevent further injury or loss of blood are the most important thing you can do. Even if some other driver caused you to be injured, it’s just good manners to help the other driver if they are hurt. They may even be so thankful that they admit their fault to you. The worst thing you can do is get angry or start a fight.

Second, make sure everyone is safe from being injured further. If you are in the middle of traffic, and you are dizzy, sit down away from traffic. If your vehicle is a traffic hazard and you have accident warning devices like flares or triangles, put them out on the road to warn other drivers and get away from the car. Let the police an other emergency personnel investigate the scene with the vehicles in place and move them more safely at a later point.

Third, call the police. Accident reports are extremely helpful if the police will do such a report. Let the police know you are injured immediately. Answer the police questions honestly. But if you are dazed or confused, let them know you need medical treatment and answer only what you feel sure about. Remember, your statements can and will be used against you if you admit fault, and it will be too late and too fishy to later say you didn’t know what you were saying at the scene. Police know that your best recollection is immediately after an accident.

Fourth, get the other driver’s information including their names, addresses, driver’s license numbers, make and model of their vehicles, license plate numbers, and their insurance company name and policy number. If there are witnesses, get their names, addresses and telephone numbers as well. If the other driver makes any admissions of fault, write those down as well.

Fifth, if you have a camera on your cell phone or in the car and you aren’t too injured, take some photos of the vehicles and the scene. If you can’t do it right away, do it after you are released from the hospital.

Sixth, if you are hurt, obtain medical treatment. Don’t decline the ambulance or hospital examination to save your insurance company money or to be stoic. Take your valuables out of your car if you can and get checked out at the hospital. If you are not hurt, don’t get treatment you don’t need. However, remember, after an accident, you may feel a rush of adrenaline that causes you to only start feeling symptoms of pain a few hours later. If you have a health plan that requires you to obtain permission first, call them and find out where you are allowed to seek treatment.

Seventh, call a good auto accident lawyer as soon as you have had your initial treatment, so the attorney can gather other important evidence and prevent the insurance company from taking advantage of you and obtaining such things as recorded statements that you feel fine, when many of your symptoms have yet to manifest themselves. A good auto accident lawyer can save you from making a great deal of mistakes and can shoulder much of the hassle of knowing what to do about car repairs, car rentals, medical treatment, witness statements and the like. If you think you will save money by not having an attorney, think again. A good auto accident lawyer can almost always obtain much higher settlements, obtain reductions of medical bills and insurance liens and prevent you from making costly mistakes. Also, most auto accident attorneys advance costs of obtaining police reports, medical records and the like and are paid and reimbursed for these costs only out of any settlement.

Eight, you will need to report the accident to your insurance company, but since they will want to take a recorded statement from you, just like any other driver’s insurance company, it’s good advice to retain an attorney first. And if the other driver did not have insurance, remember that it is your own insurance company that will be your adversary. You will also need to report the accident to the Department of Motor Vehicles and your lawyer can give you the form for this.

Ninth, do not agree to settle your claim privately with the person at fault for the accident. This almost never works out to your advantage. Don’t agree not to call the police. Police reports that determine the fault for an accident are golden. Your agreement to not involve the police only affords an opportunity for the other driver to change his story and blame you when the police will no longer investigate the accident.

Tenth, don’t pay a traffic ticket without a fight if you weren’t at fault or agree to accept a small payment for your vehicle repairs without knowing that the amount will in fact cover the cost of all the repairs.

How do i fight being blamed for an auto accident

Question by c.hill34: How do i fight being blamed for an auto accident
i was making a left turn on a green arrow, and during the turn i was hit by another driver going straight; and when the police arrived the person changed their story saying that they don’t remember running the light; so the police on scene placed the accident as no fault. when i was contacted by the other persons insurance they said that thay found me responsibe even though i had two witnesses( they said my witnesses weren’t valid, because we were friends, but we were not riding together i had one in the car with me, and the other was following)—help needed asap pleasseee!!!!

Best answer:

Answer by la buena bruja
This is difficult, because the person going straight has the right of way. Is there any way that you can find someone else who was at the scene who can testify that the arrow was green when you turned Another way would be to see if the person who ran the light has a history of bad driving/lying. Other than that, you may be falsely accused. I recommend getting a good lawyer. Good luck to you. I hope things work out for you.

What happens when auto accident is not your fault but considered “no fault”

Question by kaur: What happens when auto accident is not your fault but considered “no fault”
Well, this week I got into an auto accident and there were three witnesses as officer told me. The other driver ran the red light so I collided with them. The one witness said that there was green light for me and the other said it was green for the other lady. But I know she ran the red light but the witness just felt sorry for her. The third witness was no help as the officer mentioned to me because she had no clue about it so I don’t know why officer said she was witness. What should I do I don’t want to take blame for her. Does your insurance goes up for “no-fault” since your insurances pays for your damages In wisconsin, does your insurance goes up What happens usually

Best answer:

Answer by Pieandchips
Ok, I am assuming what you mean by “no fault,” means based on the evidence provided, the police officer couldn’t state who was at fault. Both of you are saying you had a green light.

When the evidence is inconclusive, often a claim will be rated as driver vs. driver. This means each respective insurance pays for their insured’s car, but they don’t go after the other insurance for the money. The only consequence to you in this scenario would be paying your deductible and not being able to get it back.

Your insurance is going to take recorded statements from everyone they can. Based on driver/witness statements, and the points of impact to both cars, they will decide who is liable. If everyone and everything is inconclusive, your insurance will likely side with you. If you were obeying traffic laws and no one can prove with physical evidence otherwise, they will rate your claim as not-at-fault. This does NOT bar the other company from coming after your insurance for their damages.

If the other insurance feels their driver is not at fault, they will argue their case with your insurance. If folks cannot come to an agreement, a couple different things can happen. They are:

1. Intercompany arbitration. If insurances can’t agree, in order to protect everyone from the high cost of law suits and legal fees, most companies participate in arbitration. This is similar to suit in that both insurances present all their evidence, and an independent third party will decide who’s responsible for what. Arbitration is final and binding.
2. Law Suit. If both parties can’t agree, occasionally suits happen. Really, it would have to be financially worth an attorney’s time to file suit, so this doesn’t happen much unless the other party wants a significant injury settlement. Since you didn’t mention it here, I have to assume no one was injured. If you’re worried about injuries, mention it to your insurance adjuster and ask if there is an exposure (are they claiming they’re injured and to what extent).
—————–
Your insurance shouldn’t go up unless you’re at fault, and then how much is going to depend on how much your insurance winds up paying out, and a few other factors like your driving record and prior accident history. The best way to answer this question is once your claim is resolved and your insurance knows exactly how much was paid.
Best of luck to you–I am glad everyone is (generally speaking), ok!

Who is at fault in this auto accident in Utah – I inched into instersection on green light

Question by Ashley B: Who is at fault in this auto accident in Utah – I inched into instersection on green light
in preparation for a left hand turn. I waited while all cars coming strait through the intersection went by. The light turned to yellow and then to red. I looked to be sure no cars were coming and saw none so I proceeded to clear the intersection. Just as I started to turn I saw a car coming toward me and hit my brakes. The other car driver collided with the front of my vehicle. They were going so fast that they veered 60 feet, over a curb and grass, and finally came to a stop as they collided with a brick wall of a restaurant. No one was injured (amazing). There were 2 witnesses that gave written statements to the police stating that the other driver entered the intersection after the light had turned red.
In the state of Utah you are allowed to enter the intersection while waiting to turn left and must clear the intersection if the light turns red. This is not illegal in Utah although I know it is in some other states. Please don’t say that I ran a red light because that is not the law here.

The other person seems to be at fault but technically you both ran a red light.

What should i do in a no fault auto accident

Question by tgs1606: What should i do in a no fault auto accident
A few days ago, i got into an car accident. The situation was that I entered an intersection to make a left turn. The light was green. I waited in the intersection to make the left turn, yielding to oncoming traffic. While waiting the light went from yellow then to red. After the light turned red i went ahead with the left turn to get out of the intersection. An oncoming car ran the light and hit me. When the police came, NO citation was issued to either party. Reason being the other parties unclear description to what happened. As far as i was concerned we were both going to take care of our own cars. The other parties insurance company then called me a few days later informing me they were making a claim against me and the accident was my fault because i ” failed to yield”. I was then instructed by my insurance agent to file a claim to protect myself. The problem with this whole thing is there was no witnesses on the light colors during the accident. I was told in that case the insurance companies go off of statistics. Which in that case most of the time the person making the left turn is at fault. I want to know if there is anything i can do This is my first accident and i would really appreciate some advice.
